These Terms and Conditions (“Terms”) are a binding agreement between you and Chattanooga Music Scene (“CMS,” “we,” “us,” or “our”). They govern your access to and use of this website and its accounts, profiles, community features, events, venue information, forums, groups, messages, marketplace listings, and store purchases (collectively, the “Services”). By accessing or using the Services, creating an account, submitting content, listing an item, or placing an order, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Acceptance

You must be legally able to enter this agreement. If you have not reached the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. The Services are not directed to children under 13. If you use the Services for an organization, band, venue, or business, you represent that you are authorized to bind it to these Terms. Provide accurate information and do not create an account or use the Services for unlawful or deceptive purposes.

2. Accounts and Security

You are responsible for the accuracy of your registration information, the security of your password and connected devices, and activity conducted through your account. Do not share access, impersonate another person, or attempt to obtain another member’s credentials. Notify Chattanooga Music Scene promptly if you believe an account has been compromised.

3. Community Conduct

Profiles, activity feeds, comments, groups, forums, private messages, follows, connections, and notification tools exist to support Chattanooga’s music community. You may not harass, threaten, stalk, defraud, exploit, discriminate against, or unlawfully expose another person’s private information. Spam, malicious code, coordinated manipulation, unauthorized advertising, and attempts to interfere with the website are prohibited.

Private messages are intended for their participants, but no online system can guarantee absolute confidentiality. Use good judgment and do not send passwords, payment-card details, or other highly sensitive information through community features.

4. User Content and Permissions

You retain ownership of content you submit. You grant Chattanooga Music Scene a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably necessary to operate, promote, archive, and improve the website and its community services. This permission ends when the content is deleted, except for reasonable backups, legal retention, and content already shared by others.

Submit only material you own or are authorized to use. Do not upload infringing music, photographs, video, artwork, trademarks, personal information, or other protected material. You are responsible for the accuracy and legality of your submissions.

5. Events, Venues, and Editorial Information

Event, venue, artist, and ticket information may come from organizers, members, public sources, or third parties. Dates, times, prices, lineups, availability, age restrictions, and venue details can change. Confirm important details with the organizer, venue, or original ticket source before traveling or purchasing. Submission does not guarantee publication, endorsement, or continued listing.

Chattanooga Music Scene may correct formatting, remove duplicates, add source attribution, update stale information, decline a submission, or remove content that is inaccurate, expired, unsafe, unlawful, or inconsistent with these terms.

6. Marketplace and Classified Listings

Marketplace and classified listings may connect independent buyers and sellers. Unless a listing uses an approved Chattanooga Music Scene checkout, the website is not a party to the transaction and does not guarantee identity, condition, authenticity, payment, delivery, or performance. Inspect items, verify claims, use secure payment methods, and use caution when meeting another person. Fraudulent, stolen, illegal, dangerous, misleading, or infringing items are prohibited.

7. Store Eligibility and Orders

You must provide accurate billing, shipping, and contact information when placing an order. Product availability can change without notice. We may limit quantities, discontinue products, correct errors, or cancel an order when a product is unavailable, information is materially incorrect, or fraud or unauthorized activity is suspected.

8. Products and Availability

We make reasonable efforts to describe products, colors, measurements, features, and availability accurately. Images may appear differently depending on your screen. Product names, trademarks, photographs, and other supplier materials remain the property of their respective owners.

9. Prices, Taxes, and Payment

Prices are listed in U.S. dollars unless stated otherwise. Applicable sales tax is calculated at checkout based on the shipping address. Payment is processed through the methods displayed at checkout. An order is not accepted until payment is authorized and an order confirmation is sent.

10. Shipping and Third-Party Fulfillment

We currently ship to addresses within the United States. Free standard shipping may be offered as shown at checkout. Some products may be stored, packed, or shipped by third-party fulfillment partners. Items in one order may arrive in separate packages and on different dates.

Delivery estimates are not guarantees. Carrier delays, severe weather, address errors, supply interruptions, and circumstances outside our reasonable control can affect delivery. Customers are responsible for providing a complete and deliverable shipping address. Contact us promptly if tracking shows a delivery problem. If we cannot ship within the time stated at checkout or, when no time is stated, within the time required by applicable law, we will provide any required delay notice and opportunity to consent to the delay or cancel for a prompt refund.

11. Order Changes and Cancellations

Contact us as soon as possible to request a change or cancellation. Once fulfillment or shipment begins, a change or cancellation may no longer be possible. If an order cannot be cancelled, the return policy applies after delivery.

12. Thirty-Day Returns

You may request a return within 30 days after delivery. To qualify, the item must be unused, unworn, unwashed, undamaged, and returned with its original packaging, accessories, manuals, and tags. Proof of purchase is required.

Contact Chattanooga Music Scene before sending a return. Do not send products to the business address or an address shown on a package unless we provide that return address and instructions. Products fulfilled by different suppliers may require different return destinations.

Unless an item arrived damaged, defective, materially different from its description, or was sent in error, the customer is responsible for approved return-shipping costs. Original expedited-shipping charges are not refundable. Use of a trackable return method is recommended.

The following are not returnable unless defective or required by law: personalized or custom-made goods, gift cards, downloadable or digital products after delivery, hygiene-sensitive goods after opening, and products marked final sale.

13. Damaged, Defective, Incorrect, or Missing Items

Inspect your order promptly. Contact us with the order number, a description, and clear photographs when an item arrives damaged, defective, incomplete, or incorrect. We may request reasonable evidence. Depending on the circumstances and availability, we may offer a replacement, refund, or other appropriate remedy.

14. Refunds

Approved refunds are issued to the original payment method after the returned item is received and inspected, or after a claim is otherwise approved. Bank and payment-provider processing times vary. We may reduce or deny a refund when a returned product does not meet the stated conditions, except where prohibited by law.

15. Intellectual Property

The Chattanooga Music Scene name, site design, original text, graphics, software, and other original content are protected by applicable intellectual-property laws. No rights are transferred except the limited right to use the website for its intended personal or community purposes. Do not copy, scrape, republish, sell, or exploit protected content without permission or another lawful basis.

16. Third-Party Services and Links

The website may use or link to ticket sellers, payment processors, carriers, fulfillment providers, analytics services, social platforms, organizers, venues, and other websites. Their services are governed by their own terms and privacy practices. Chattanooga Music Scene does not control independent third-party services and is not responsible for them except to the extent required by law.

17. Moderation, Suspension, and Termination

We may review, limit, hide, reject, or remove content and may warn, suspend, or terminate accounts when reasonably necessary to protect members, comply with law, enforce these terms, prevent fraud or abuse, or preserve website security. We may also preserve information when required for security, dispute resolution, or legal compliance.

18. Disclaimers and Limitation of Liability

The website, community features, information, listings, and store services are provided subject to warranties and rights required by law. Chattanooga Music Scene bears no responsibility for user-submitted content, independent marketplace transactions, third-party services, event cancellations or changes, venue actions, or losses caused by reliance on information supplied by users or third parties. To the fullest extent permitted by law, Chattanooga Music Scene disclaims implied warranties not expressly stated and is not liable for indirect, incidental, special, punitive, or consequential damages. Liability relating to a store purchase will not exceed the amount paid for the product giving rise to the claim. Nothing in these Terms excludes or limits any responsibility, right, warranty, remedy, or liability that applicable law does not permit to be excluded or limited.

19. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the website, violation of these terms, content you submit, or infringement of another person’s rights.

20. Privacy

Use of personal information is also governed by the Privacy Policy. Do not publish information about another person without permission or another lawful basis.

21. Governing Law

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute will be handled in an appropriate court with jurisdiction in Georgia, unless applicable law requires otherwise.

22. Electronic Communications

When you use the Services or contact us electronically, you consent to receive communications from us electronically, including notices related to your account, transactions, and these Terms. You are responsible for keeping your contact information current. This does not alter any separate consent required by law for marketing messages.

23. Changes to These Terms

We may update these Terms when our practices, Services, or legal requirements change. The revised version will be posted on this page with an updated date. Material changes apply prospectively after posting or after any additional notice required by law. Your continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

24. General Provisions

These Terms and the policies expressly incorporated by reference constitute the entire agreement between you and CMS regarding the Services and replace prior agreements on the same subject. If a provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent; we may assign these Terms in connection with a merger, reorganization, sale of assets, or by operation of law. Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions.
